Terms and Conditions - Poppies, Sorrel Cottage and West Creek Cottage
An initial reservation may be made by telephone, post, fax, email or online and will be held for 7 days pending the return of the completed booking form or letter and initial deposit. If the deposit is not received within this time frame the dates will be released.
The sending of a deposit for a reservation confirms your acceptance of the terms and conditions set out below and shall be binding on you and all persons stated in the booking. You are accepting these terms on their behalf. Once the reservation has been confirmed and a deposit paid the named person on the booking will be responsible for the total rental price of the property as agreed.
The occupation shall be in the form of a holiday/vacation rental only and does not constitute a permanent or primary residence or other tenancy. Occupancy shall begin on and terminate on the arrival and departure dates listed on the booking form. The premises shall not be used for any business, professional, unlawful or hazardous purpose.
Payment
A deposit of £100 per week is required to confirm the booking. The remaining balance must be paid no less than 8 weeks before the arrival date (please allow 3 working days for cheque clearance). Bookings made within 8 weeks of arrival are payable in full. On clearance of the party’s full payment, including a security deposit, full information and directions will be sent. Cheques should be made payable to Mrs D Harris.
Security Deposit
A security bond of £100 must be paid at the same time as the final balance to cover against any damage/breakages/loss to the properties or their contents. It is refundable within 14 days of leaving the properties, pending an inspection by our local agents. Any damage to the house, contents or grounds will be deducted from this bond and the full amount may be retained if warranted. Please note we are not liable for any fines or summons as a result of your party’s actions.
Cancellations
Any cancellations must be made in writing. We reserve the right to cancel the booking if payment has not been made in accordance with the conditions above.
The following cancellation charges will apply:
More than 8 weeks prior to departure – loss of booking deposit
4-8 weeks prior to departure – 50% of total rental cost
Within 4 weeks – 100% of total rental cost.
Accommodation
Names of all guests must be provided at the time of booking. To ensure comfort, security and compliance with licensing legislation, only persons named may occupy the properties and subletting, sharing or assigning is prohibited. Poppies sleeps a maximum of 6; Sorrel Cottage sleeps a maximum of 4; West Creek Cottage sleeps a maximum of 3 and this may not be exceeded.
The property is available from 3pm on the day of arrival unless otherwise agreed. It must be vacated by 10am on the day of departure to allow our housekeepers access.
An adult must accompany persons under the age of 18.
No multiple single sex bookings ie. stag /hen parties are permitted without prior agreement.
If any breakages occur, guests can replace the items like for like at no additional cost.
The cottages are no smoking and animals and pets are not permitted.
Linen and towels are provided but guests are responsible for laundry of such items themselves as required during their stay, together with day to day cleaning of the home and garbage removal.
Noise in the property must be kept to a reasonable level as not to cause a disturbance to the neighbours or general public. You and your party must at all times be courteous to neighbours and the general public and not do anything to cause a nuisance.
Safety
You occupy the property at your own risk and are responsible for your own actions and omissions whilst you are there.
Insurance
We strongly recommend that you ensure you have adequate travel and health insurance for the duration of your stay to cover any unforeseen circumstances which may necessitate the cancellation of your holiday or additional expenses being incurred by members of the party.
Passports and Visas
It is the responsibility of overseas guests to ensure that all those travelling in the party have complied fully with passport and visa requirements to visit England. Any failure in this respect may result in your travel arrangements being amended/curtailed with consequential losses in respect of your booking. In such circumstances no liability attaches itself to the owner.
Exclusions of Liability
You occupy the property and you keep your possessions there at your own risk. The owners, the management company, their agents and employees do not accept liability for death, injury, accidents, theft, loss or damage to persons or personal effects or any liability for incidental or consequential loss howsoever caused or arising during your stay; and such liability is therefore extended to the maximum extent permissible by law. It is your responsibility to ensure the properties are secured at all times during your stay and that all doors and windows are locked while you are away. Please take care of the key – loss will result in the full security bond being forfeited.
Force Majeure
The owners, the management company, their agents and employees cannot accept responsibility or be held liable for loss or delay arising from the following: strikes, riots, political unrest, hostilities, war or threat of war, terrorist activity, industrial action or disputes, problems with suppliers of goods or services, fire, flood, hurricane, weather problems or conditions, transport problems, aircraft grounding, closure of ports or airports or any other event beyond our control.
Complaints or dissatisfaction
In the unlikely event of a complaint during your stay please contact the owner so that remedial action can be taken. If the problem has not been reported during the stay, the owner cannot accept any responsibility.
Guests must allow access to the property for the owner/agents upon 24 hours notice for essential repairs or maintenance.
All bookings are made subject to these terms and conditions, and these terms and conditions are governed by English law. In the event of any dispute, the parties agree to submit to the exclusive jurisdiction of the English courts.
